These terms apply to use of dayanfotos.com and to every image licence purchased through Dayan Fotos. By creating an account or purchasing a licence, you agree to these terms.

Accounts

You must provide accurate information, keep your login and authentication details secure and notify Dayan Fotos through the registered-user contact form if you believe your account has been compromised. You are responsible for activity performed through your account.

Images and Copyright

All photographs, previews, text and other original material on the website remain protected by copyright and other applicable rights. Purchasing a licence grants permission to use the selected image within the stated licence; it does not transfer ownership or copyright.

Public previews are watermarked and may be used only to evaluate an image before licensing. They may not be removed, republished or commercially used.

Licence Options

Every licence is worldwide, non-exclusive, non-transferable and limited to one declared project.

• Online: use in one named website, digital publication or campaign, including associated social-media promotion, for five years. Previously published articles may remain in their archives.
• Print: use in one named publication or project, for one edition and a maximum print run of 100,000 copies.
• Print + Online: combines the Online and Print permissions for the same declared project.

A new campaign, edition, unrelated project or use outside the selected permission requires a new licence.

Prohibited Uses

An image may not be resold, sublicensed, transferred, used as a logo or trade mark, included in a template, offered as a stock asset, used on merchandise, used for AI or machine-learning training, or used unlawfully, deceptively or in a defamatory context. Images may not be altered in a way that materially misrepresents their subject or Frida Dayan’s work.

Where reasonably possible, the credit should read: Photo: Frida Dayan / Dayan Fotos.

Prices and Payment

Prices are displayed in United States dollars. Full payment through PayPal is required before a licence is issued or the unwatermarked licensing master becomes available. No VAT is charged by Dayan Fotos. Any bank, currency-conversion, tax or similar charge imposed on the buyer remains the buyer’s responsibility.

Downloads and Refunds

You should download and securely retain the licensed file after payment. If a technical problem prevents access to a purchased image, contact Frida through your account so that access can be restored.

Because the licensed digital file is supplied immediately after payment, orders cannot ordinarily be cancelled merely because the buyer changes their mind after accessing or downloading it. This does not affect any mandatory consumer rights or a remedy where the wrong file was supplied, the file is defective or the service was materially misdescribed.

Availability and Liability

Reasonable care is taken to keep the website secure and available, but uninterrupted access cannot be guaranteed. To the fullest extent permitted by law, Dayan Fotos is not liable for indirect or consequential loss arising from use of the website or an image. Nothing in these terms excludes liability that cannot lawfully be excluded.

Suspension and Governing Law

Access may be suspended or terminated where an account is used fraudulently, unlawfully, to interfere with the service or in material breach of these terms. Existing valid licences remain subject to their original terms unless obtained through fraud.

These terms are governed by the laws of Israel, subject to any mandatory rights that apply in the customer’s place of residence.
